Terms of Service
These terms govern your use of CigarCabinet. Please read them — creating an account means you agree to them.
1. Agreement
These Terms govern your use of CigarCabinet (the "Service"), operated by CigarCabinet LLC ("we", "us"). By creating an account or using the Service you agree to them. If you do not agree, do not use the Service.
2. Eligibility
The Service is intended for adults of legal age to purchase tobacco products in their jurisdiction, and in no case under 21. You represent that you meet this requirement. We do not sell, ship, or broker the sale of tobacco.
3. Your account
You are responsible for activity under your account and for keeping your credentials secure. Authentication is handled by our identity provider. You agree not to share credentials or to access the Service through another person's account.
4. Acceptable use
You may use the Service to manage your own collection. You may not:
- Access the Service by automated means. No scraping, crawling, spidering, scripted access, headless browsers, or bulk or systematic retrieval of any part of the Service, except by a general-purpose search engine obeying our robots.txt.
- Extract or compile our data. No copying, downloading, or reproducing the cigar catalog, its specifications, its aging windows, or any substantial part of it, whether in a single request or by accumulating many. No creating a database, dataset, or competing product derived from it. No using it as training data for a machine-learning model.
- Circumvent controls. No defeating, testing, or working around authentication, rate limits, quotas, paywalls, or access restrictions. No using another account, a shared token, or a session you were not issued.
- Interfere with the Service. No activity that degrades or disrupts the Service or the infrastructure behind it, and no probing or scanning of its systems.
- Misuse other users' information. No collecting, aggregating, or redistributing other users' names, posts, venues, or activity.
- Reverse-engineer. No decompiling or disassembling the Service, and no deriving our aging model, catalog, or algorithms from its outputs, except where such a restriction is unenforceable by law.
We may suspend or terminate an account, and rate-limit or block traffic, for any breach of this section.
5. Intellectual property
Ours. The Service, its software, its design, the cigar catalog, the aging model, and the selection, arrangement and enrichment of the catalog data are owned by us or our licensors and are protected by copyright, database and other laws. Individual facts about a cigar are not ours; the compilation, the specification set, and the computed aging windows are. No licence is granted except the limited, revocable, non-transferable right to use the Service as intended.
Yours. You keep ownership of what you enter — your inventory, tasting notes, ratings, photos and posts. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display that content for the purpose of operating the Service, including displaying posts you choose to publish to other signed-in users. You may revoke that licence by deleting the content or your account, except where it has already been shared with others or is retained in backups.
Aggregates. Community ratings are computed only from users who opt in, and are presented only in aggregate. You grant us the right to include your ratings in those aggregates while you are opted in.
6. Subscriptions and payment
Free and paid ("Pro") tiers are described on our pricing page. Paid subscriptions are billed in advance through our payment processor on the interval you select, and renew automatically until cancelled. You may cancel at any time; access continues to the end of the paid period. Fees already paid are non-refundable except where required by law or at our discretion. We may change prices on notice, effective at your next renewal.
7. Your data
You may export or delete your data. On account deletion we remove your personal content in accordance with our Privacy Policy; anonymised aggregates, and records we are required to keep for legal or accounting reasons, may persist.
8. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms, for suspected fraud or abuse, or if we discontinue the Service. On termination the licences granted in section 5 end, except as noted there.
9. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law.
Aging guidance is informational. Aging windows, prime bands and phase labels are estimates produced by a model from a cigar's wrapper, strength and dimensions. They are not a guarantee about any particular cigar, they cannot account for your storage conditions, and they are not advice about the condition, safety, value or authenticity of anything you own. Catalog specifications are gathered from manufacturers and public sources and may be incomplete or incorrect.
Nothing in the Service is health advice. Tobacco use carries serious health risks.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or the value, condition or loss of any cigar or collection. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months preceding the claim, or USD 100.
11. Changes
We may amend these Terms. Material changes will be notified in the app or by email before they take effect, and the version number at the top of this page will change. Continued use afterwards constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in the State of Colorado, and you and we each consent to personal jurisdiction and venue there.
